Incorporation information: The Trade, Crafts and Fashion Consortium of Catalunya, hereinafter CCAM, created under agreement GOV/143/2009 of 15 September (DOGC no. 5470 of 23.09.2009) is the agency of the Government of Catalunya responsible for promoting and supporting trade, crafts and fashion in Catalunya in order to strengthen the quality and competitiveness of these sectors, both nationally and internationally.

General Terms of Use:
1. Users
Anyone who accesses the website is considered a user and in doing so accepts these General Terms of Use, fully and without reservation.
2. Use of the website
The user agrees to use the website and its services and contents without violating any current legislation, principles of good faith, generally accepted uses and the public order.
Any use of the website that is illegal or harmful to the CCAM or third parties or that could cause harm or impede the normal operation of the website is prohibited.
3. The User’s Responsibility
The user is solely responsible for his or her use of the website. This responsibility includes the use of passwords or similar assigned to access the website or any of its services by the user or by third parties.
The above notwithstanding, the CCAM reserves the right to refuse access to users who violate these terms and conditions at any time and without prior notice.
4. Reservation of Rights
The CCAM reserves the right to modify the structure and design of the website, as well as to modify or eliminate services, contents and access and/or usage conditions of the website, unilaterally and without notice, as deemed appropriate.
The CCAM reserves the right to discontinue, suspend or terminate the website or any of the services rendered through the website.

The CCAM does not warranty and is not liable in any way for damages of any kind arising from:
- Lack of availability, maintenance and effective operation of the website and/or its services or contents.
- Lack of usefulness, suitability or validity of the website and/or its services or contents inasmuch as the specific needs, activities, results or expectations of users are concerned.
- The existence of viruses, malware or damaged contents.
- Any use of the website, its services or contents by the user that is illegal, negligent, fraudulent, contrary to these General Conditions, the principles of good faith, generally accepted uses or the public order.
- Failure by third parties to fulfil their obligations or commitments in connection with the services provided to users through the website.
Broadcasting platform
The CCAM is the owner of www.bcncrafts.com and makes this site available to Internet customers to allow them to purchase the products offered through the website.
On 27 June 2014, after complying with all legal formalities under Law 30/2007, the Director of the CCAM issued a resolution awarding the concession for the use and operation of the Artesania Catalunya shop located at carrer Banys Nous, número 11 to market the products in the Empremtes de Catalunya catalogue, including the ONLINE SHOP, to SANTIAGO MARTÍN SUBIRATS.
Therefore, users wishing to make purchases from the online shop may do so exclusively through the concession holder:

These products are made available to the public for the purpose of promoting and incentivising Catalan artisan crafts.
The CCAM simply provides a space for transactions between buyers and sellers. Therefore, the contract that is generated once a product is purchased from an external vendor involves only the buyer and the seller of the product. The CCAM is not part of the contract, assumes no responsibility for it and is not the vendor’s representative. The vendor (concession holder) is responsible for selling the products and for providing assistance to buyers who have complaints or any other matter related to the contract between buyer and seller.
The CCAM is not the owner of the products offered on the website.
The CCAM allows the contents and data to be reused by anyone, without time limitations or restriction of any kind other than the basic conditions set out in Article 8 of Law 37/2007 (citing the source, no alteration or distortion of information and specification of date of last update), provided that such reuse does not contravene any license or warning that comes with a particular product, in which case the latter will prevail.

Law 37/2007 of 16 November on the reuse of public sector information, which transposes Directive 2003/98/EC of the European Parliament and of the Council, regulates the reuse of public information available through public administrations and bodies, i.e., the right of all potential market operators to reuse public information.

The CCAM does not market, direct or control the contents, services, products, information or statements available on such websites.
The CCAM declines any direct or indirect liability for damages of any kind arising from the access, maintenance, use, quality, legality or reliability of the contents, information, communications, opinions, demonstrations, and existing products and services offered on websites not managed by CCAM that are accessible through www.bcncrafts.com.

Personal data protection and privacy policy
The CCAM may use forms on the website to gather personal data and information from users for storage and/or use. Data provided by users will be incorporated into a database by the name of FINANCIAL MANAGEMENT owned by CCAM (ORDER EMO/284/2014 of 15 September, which authorised the creation of personal data files by the Trade, Craft and Fashion Consortium of Catalunya).
For each form used to collect personal data, users will receive detailed information from CCAM about the processing, purpose and use of the data, whether the responses are mandatory or optional, the consequences of refusing to provide the information and, in general, all other information required by the personal data protection laws, which must be expressly accepted by the user.

Jurisdiction
The general conditions of this Disclaimer are governed by Spanish law. The user, expressly waiving any other jurisdiction, agrees to be bound by the jurisdiction of the Courts of Barcelona for any actions associated with the provision of the web services and the website’s contents and services or with the interpretation, application, fulfilment or breach of the terms established herein.
